Terms and Conditions
Preamble:
The Home-et-bain online store was set up by the company CC PRESTATIONS which operates this site. Any order for a product displayed on the Home-et-bain site via the site constitutes unconditional acceptance of these general terms and conditions of sale. The act of ordering online, and therefore accepting the general terms and conditions of sale, supersedes the handwritten signature of the order. The general terms and conditions of sale are subject to change; in this case, the update is dated and applies only to orders placed after the new date.
Article 1 - Scope of application:
These T&Cs apply to all sales concluded on the Site between Home Et Bain and any user of the Site (hereinafter the "Customer"). Any purchase on the Site implies the Customer's unconditional acceptance of these T&Cs.
Article 2 - Products:
The products offered for sale are those presented on the Site. Photographs of products are provided for illustrative purposes only. The customer is invited to refer to the description of each product to learn its precise characteristics. The prices of products are indicated in euros, all taxes included. Home-et-bain reserves the right to change its prices at any time but the products will be invoiced based on the rates in effect at the time of order registration.
Article 3 - Prices:
Payment for items is made in full at the time of ordering. The sale prices indicated on the Site are in euros and all taxes included but excluding delivery charges. Delivery charges are indicated to the Customer as they select products and the chosen delivery method. The total amount is indicated to them at the end of the ordering process, in addition to the price of the selected products, before confirmation of acceptance by the Customer. Various promotions applied on the site cannot be combined with other promotions in-store. Home Et Bain reserves the right to change its prices at any time but undertakes to apply the rates indicated on the Site at the time of your order.
Article 4 - Order:
Registration of the order is confirmed by displaying the order number and by sending an email confirming this element. The order is therefore considered accepted only upon confirmation by Home Et Bain. Orders placed remotely but which do not result in online payment are validated manually by email exchange, provided that the customer declares at the time of signing their order form that they have read these general terms and conditions of sale.
Article 5 - Payment:
Payment is made online by credit card via the secure payment service SystemPay, by bank transfer, or by Paypal. It is understood that the availability period of the merchandise begins from the moment payment is made. When paying, the customer is automatically connected to the secure payment service SystemPay. Bank data is secure, encrypted, and will not be stored on Home-et-bain's computer servers but managed by the payment provider SystemPay.
Article 6 - Delivery:
Products are delivered to the address indicated on the order form or to a relay point. Delivery times are communicated to the customer in their cart at the time of order and are provided for information purposes only. The products remain the property of Home Et Bain until full payment of the price by the Customer.
Article 7 - Right of withdrawal:
The customer has a period of fourteen (14) working days from the day after receipt of the last product of their order to exercise their right of withdrawal without having to justify reasons or pay penalties, on the merchandise, except for outbound and return transport costs. The right of withdrawal does not apply to orders for products made to the customer's specifications or clearly personalized. To exercise their right of withdrawal, the customer must inform Home-et-bain of their decision to withdraw by email.
Article 8 - Warranty:
The products sold on the Site are guaranteed in accordance with current legislation. The warranty claims for products are at the discretion of the manufacturer only. For any warranty claim, the customer can contact Home-et-bain's customer service by email, which will act as an intermediary between the two parties.
Article 9 - Foreign sales:
In the case of an order intended for a country outside Metropolitan France, the customer is automatically the importer of the product(s) concerned. For all products shipped outside the European Union and Overseas Territories, customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Home-et-bain. They are borne by the customer and are their full responsibility, both in terms of declarations and payments to the authorities and competent bodies of their country.
Article 10 - Retention of title:
By express agreement, Home-et-bain remains the owner of the goods until the day of their full payment by the customer.
Article 11 - Liability:
Home-et-bain's liability cannot be engaged for any inconvenience or damage inherent in the use of the Internet network, including a service interruption, external intrusion, or the presence of computer viruses.
Article 12 - Applicable law - Language:
This contract is subject to French law. The language of this contract is French. In the event of a dispute, French courts will have exclusive jurisdiction.
